Affiliate Agreement

Effective Date: July 13, 2007

Welcome to the BamaPages.com Affiliate Agreement ("Agreement"). This Agreement sets forth the terms and conditions under which BamaPages.com  makes the BamaPages.com  ("Affiliate Program") available to you. By becoming a BamaPages.com  Affiliate and using the Affiliate Program you expressly agree to be bound by and follow all terms and conditions set forth in this Agreement. If you do not agree to be bound by this Agreement, your sole recourse is not to participate in the Affiliate Program.

Relationship of Parties
You and BamaPages.com are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on Your Site or otherwise, that reasonably would contradict anything in this section.

Commissions
You will receive commissions from orders placed through your Affiliate Site. For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered.  As an affiliate you will receive 25% of the total sale.  Example:  Our sponsored business listing is $1599.  If you successfully refer a Business owner who purchases a sponsored business listing you will receive a commission of $399.75.

Enrollment in the Program:
In order to enroll in the program, you will need to complete the Program Application. We may remove you from the Program if we determine that your site is unsuitable or if you are Spamming or participating in activities in which BamaPages.com deems unsuitable for your continuance in the BamaPages.com affiliate program.

Order Processing
You will be credited for orders that have been placed with the Affiliate User Name you select when signing up to the Program. We will handle all customer service, customer support, product returns, cancellations and refunds for our products.

Referral Fee Schedule
Referral revenue is paid to you monthly by the 10th of the following month. Accounts with a balance less than $100.00 will be carried over to the following pay period.

Indemnification
You agree to indemnify and hold BamaPages.com, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another.

BY USING THIS SERVICE, YOU AGREE TO ABIDE BY THE TERMS OF USE AGREEMENT.
